Terms and conditions

By booking a journey with Abacus Coaches, either verbally or in writing, you agree to abide by the following terms and conditions:

Quotations. Quotations are provided on the basis of information provided by the hirer. The route used is at the discretion of Abacus (unless specified by the hirer and clearly shown on the booking confirmation).

Bookings. A quotation only becomes a booking when the contract exchange has taken place. The hirer will receive a confirmation from Abacus in the form of an invoice and the hirer will confirm back to Abacus the details are correct.

Deposit. A non-refundable £50 deposit must be paid in order to confirm the booking unless agreed with Abacus.

Payment. Unless otherwise specified the full payment for the hire must have cleared one week prior to departure or as a default at the discretion of Abacus cash on the day before departure.

Cancellation by the hirer. If the hirer cancels within 24 hours of a booked journey the hirer is obligated to pay 50% agreed hire price. If a cancellation is Covid related and cancelled within 24 hours of departure the hirer is obligated to pay 25% agreed hire price, reclaimable by the hirer if the same hire is rebooked for a later date.

Cancellation by Abacus. In the event of circumstances beyond Abacus’ control (e.g. Covid infections, strikes, adverse weather) Abacus will return the deposit and without further liability cancel the hire contract.

Responsibility. The hirer (the individual who makes a booking) is responsible for the actions of all passengers on board the vehicle and will be responsible for any additional costs incurred whether or not they travel with the party. Abacus can only accept instructions from the hirer. If the hirer is not travelling with the party a representative must be chosen and Abacus must be informed beforehand.

Use of vehicle. The hirer cannot assume use of the vehicle between the outward and return journey unless previously agreed by Abacus.

Route and time variation. Abacus reserves the right to levy additional charges for additional mileage or time other than that agreed. The vehicle will depart at times agreed by the hirer; it is the responsibility of the hirer to account for all passengers at those times. Abacus will not accept liability for losses incurred by passengers who fail to follow hirer’s instructions.

Drivers’ hours. The hours of operation for the driver are regulated by law. Neither the hirer nor passengers shall delay or interrupt the journey in such a way that the driver is breaching regulations. If a breach occurs the hirer is responsible for any additional costs incurred.

Seating capacity. At the time of booking the legal seating capacity will be specified. The hirer must not load the vehicle beyond capacity.

Vehicle to be provided. Abacus reserves the right to provide a larger vehicle than that specified unless specifically instructed not to do so. In such circumstances no additional charges will be levied. Abacus reserve the right to substitute another vehicle (including those of other operators) for all or part of hiring subject to substitute being of equivalent value.

Breakdown and delays. Abacus gives advice on journey time in good faith. However, as a result of breakdown, traffic congestion or other events beyond Abacus’ control the journey may take longer than expected. In these circumstances Abacus will not be liable for any inconvenience or loss caused to the hirer.

Agency arrangements. When Abacus hires in vehicles or arranges other ancillary services the hirer will be bound by the terms and conditions imposed by such other suppliers.

Conduct of passengers. The driver is responsible for the safety of the vehicle at all times and may remove any passengers from the vehicle whose behaviour is deemed to pose a risk to the safety of them-selves, other passengers or the vehicle. The hirer is responsible for any damage caused to the vehicle by any passenger for the duration of the hire. Where the vehicle is booked to attend an event the hirer should be aware of legal requirements relating to the alcohol and conditions of entry to the event.

Passengers’ property. Vehicles are subject to restrictions on carrying luggage for safety and space reasons. It may be possible to add a luggage trailer on minibus hires. Please discuss exceptional luggage at the time of booking. Abacus is not responsible for loss or damage to personal property.

Animals. No animals, other than guide dogs notified to Abacus in advance, may be carried on a vehicle without the prior written agreement.

Refreshments and alcoholic drinks. Food and drink may not be consumed on the vehicle without prior consent. Under no circumstances will greasy hot food be allowed (e.g. takeaways). If deemed acceptable the hirer must take responsibility to ensure the cleanliness of the vehicle.

Data. Customers’ data will not be sold to third parties and will only be used confidentially for the purposes of Abacus’ communications with the hirer.

Complaints. In the event of a complaint the hirer should seek a solution at the time from the driver. If a remedy has not been provided the complaint should be submitted in writing to Abacus within 14 days of the hire.
